THE SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA, WHO AS THE DATE OF ENTRY ARE AT LEAST 18 YEARS OLD OR THE AGE OF MAJORITY IN THEIR STATE OF RESIDENCE, WHICHEVER IS GREATER, AND LEGAL RESIDENTS OF CANADA, WHO AS OF THE DATE OF ENTRY ARE OF THE AGE OF MAJORITY IN THEIR PROVINCE OR TERRITORY OF RESIDENCE, EXCEPT RESIDENTS OF THE PROVINCE OF QUEBEC WHO ARE INELIGIBLE TO ENTER OR WIN. 1. SPONSOR: Disney Destinations, LLC (“Sponsor”), PO Box 10000, Lake Buena Vista, FL 32830.
2. ADMINISTRATOR: PrizeLogic LLC (“Administrator”), 25200 Telegraph Road, Suite 405, Southfield, MI 48033, the independent agency administering the Cruise Travel Sweepstakes (the “Sweepstakes”).
3. eligibility: Open only to legal residents of the 50 United States or the District of Columbia, who as of the date of entry are at least 18 years old or the age of majority in their state of residence, whichever is greater, and legal residents of Canada, who as of the date of entry are of the age of majority in their province or territory of residence, except residents of the Province of Quebec who are ineligible to enter the Sweepstakes. Residents of Puerto Rico are also ineligible to enter. Officers, directors, and employees (and members of their household or immediate family, i.e., parents, children, spouse, siblings, grandparents, the “steps” of each and persons residing in such immediate family members' household) of Sponsor, Administrator, DDB Worldwide Communications d/b/a Tribal DDB New York, Facebook, Inc., their respective parent, related, affiliated and subsidiary companies, their advertising, promotion and web design agencies, all other entities involved in the creation, administration, or fulfillment of the Sweepstakes and their respective successors and assigns are not eligible to enter or win.
4. TO ENTER: The Sweepstakes starts at June 28, 2010 at 12:00 A.M., ET and ends September 30, 2010 at 11:59:59 P.M., ET (“Entry Period”). You can enter the Promotion through the http://apps.facebook.com/dcltraveler/ application on the Facebook Platform. You will have an option of either (1) immediately playing the Dream Traveler Game (“Game”) and registering to enter the Sweepstakes at a later time or (2) immediately registering to enter the Sweepstakes and obtaining an entry by providing all of the required information, i.e. your name, address, valid email address (“Address”), telephone number and date of birth and acknowledging that you have read and agree to be bound by these Official Rules (individually, an “Entry” and, collectively, “Entries”). Playing the Game is solely for your enjoyment purposes and has no effect on your selection as a potential winner of the Sweepstakes. To play the Game, you must be at least 13 years or older as of the date of playing the Game; however, to enter the Sweepstakes, you must be at least 18 years old or the age of majority in your state of residence in the 50 United States/DC, whichever is greater, or the age of majority in your province or territory of residence in Canada, as stated in “Rule 3 – Eligibility”. Residents of Quebec and Puerto Rico are not eligible to enter the Sweepstakes. Limit of one (1) Entry per person throughout the Entry Period regardless of the email address used. Entries must be received no later than 11:59:59 P.M., ET on September 30, 2010.
5. RANDOM DRAWING & ODDS OF WINNING: On or about October 6, 2010, a random drawing will be held to select the name of the potential Grand Prize Winner (the “Winner”) from among the total number of all eligible Entries received during the Entry Period. The drawing will be conducted by Administrator, and its decisions will be final in all matters pertaining to the random drawing. The odds of winning the Grand Prize depend upon the total number of all eligible Entries received during the Entry Period. The potential Winner will be notified on or about October 13, 2010 by either email, phone, postal mail and/or courier.
6. SKILL QUESTION APPLICABLE TO POTENTIAL WINNERS WHO ARE RESIDENTS OF CANADA: A potential Winner who is a resident of Canada will be required to correctly answer, without assistance of any kind, whether mechanical or otherwise, a time limited mathematical skill testing question, administered either by mail or electronically, as designated by Administrator. If the potential Winner cannot be contacted and/or does not correctly answer the skill question within fourteen (14) business days of notification, s/he will forfeit the Grand Prize and, time allowing, an alternate potential Winner may be selected in accordance with these Official Rules (the “Rules”).
7. GRAND PRIZE (1): The Winner will receive one (1) Disney Cruise Line® vacation for four (4) persons. The Winner may choose one of the following Disney Cruise Line® vacations: Disney’s 7-Night Mexican Riviera Cruise Vacation (the”Mexican Riviera Cruise”); Disney’s 7-Night Eastern Caribbean Cruise Vacation (the “Eastern Caribbean Cruise”); or Disney’s 7-Night Western Caribbean Cruise Vacation (the “Western Caribbean Cruise” and, collectively with the Mexican Riviera Cruise and Eastern Caribbean Cruise, the “Grand Prize Vacation Package”). (A) The Mexican Riviera Cruise shall consist of the following: Four (4) round-trip coach airfares between the major U.S. or Canada gateway airport closest to the Winner’s residence and Los Angeles International airport, provided however, if Winner resides within 200 miles of Los Angeles, CA airfare will not be provided to the Winner; Four (4) round-trip ground transfers between Los Angeles International Airport and Port of Los Angeles via air-conditioned motorcoach; and Seven (7) night cruise for four (4) persons aboard the a Disney cruise ship to Disney’s Mexican Riviera itinerary embarking at the Port of Los Angeles and including the ports of Puerto Vallarta, Mazatlan and Cabo San Lucas, including: One (1) stateroom (Category 9), maximum occupancy four (4) people; all meals onboard the cruise ship; Government Taxes and Fees (as defined on the Disney Cruise Line® website), and any fuel surcharge; and onboard gratuities for stateroom host/hostess, dining room server, assistant server and head server. The estimated retail value of the Mexican Riviera Cruise is $6,254.92 USD, $6,611.45 CAD. (B) The Eastern Caribbean Cruise shall consist of the following: Four (4) round-trip coach airfares between the major U.S. or Canada gateway airport closest to Winner’s residence and Orlando International Airport in Orlando, Florida; provided, however, if the Winner resides within 200 miles of Orlando, Florida, airfare will not be provided to the Winner; Four (4) round trip ground transfers between Orlando International Airport and Port Canaveral via Disney Cruise Line® transportation; and Seven (7) night cruise for four (4) persons to be taken aboard a Disney cruise ship to Disney’s Eastern Caribbean itinerary which includes the ports of St. Thomas, St. Marteen and Castaway Cay in the Bahamas and includes: One (1) stateroom (Category 9), maximum occupancy four (4) people; all meals onboard the cruise chip; Government Taxes and Fees(as defined on the Disney Cruise Line® website), and any fuel surcharge; and onboard gratuities for stateroom host/hostess, dining room server, assistant server and head server. The estimated retail value of the Eastern Caribbean Cruise is $7,316.76 USD, $7,733.82 CAD. (C) The Western Caribbean Cruise shall consist of the following: Four (4) round-trip coach airfares between the major U.S. or Canada gateway airport closest to winner’s residence and Orlando International Airport in Orlando, Florida; provided, however, if Winner resides within 200 miles of Orlando, Florida, airfare will not be provided to the Winner; Four (4) round trip ground transfers between Orlando International Airport and Port Canaveral via Disney Cruise Line® transportation; and Seven (7) night cruise for four (4) persons to be taken aboard the cruise ship to Disney’s Western Caribbean itinerary which includes the ports of Key West, Grand Cayman, Cozumel and Castaway Cay in the Bahamas and includes: One (1) stateroom (Category 9), maximum occupancy four (4) people; all meals onboard the cruise ship; Government Taxes and Fees (as defined on the Disney Cruise Line® website), and any fuel surcharge; and onboard gratuities for stateroom host/hostess, dining room server, assistant server and head server. The estimated retail value of the Western Caribbean Cruise is $7,397.56 USD, $7,819.22 CAD. NOTE: Regardless of the Grand Prize Vacation Package selected, the following items, costs and/or expenses are not included as part of the Grand Prize and are solely the Winner’s responsibility: Transportation between the Winner’s residence and the departure airport; Shore excursions; Travel insurance; Laundry service; Spa treatments; Alcoholic beverages; Local and long distance telephone calls; Ship to shore communications including Internet; Merchandise and souvenirs; Incidental expenses; Tips and gratuities not specifically included above; and all other charges not otherwise included above.
8. GRAND PRIZE TERMS, CONDITIONS & RESTRICTIONS: The Mexican Riviera Cruise must be booked at least forty-five (45) days prior to the intended travel dates and must be taken prior to November 6, 2011. The Mexican Riviera Cruise is not available for travel in 2010. The 2011 Block out dates for the Mexican Riviera Cruise will be released in June 2010. The Eastern Caribbean Cruise and the Western Caribbean Cruise must be booked at least forty-five (45) days prior to the intended travel dates and must be taken prior to November 6, 2011. The 2010 block out dates for the Eastern Caribbean Cruise are April 10 – November 6, 2010; November 20, 2010 and December 30, 2010. The 2011 block out dates for the Eastern Caribbean Cruise will be released in June 2010. The 2010 block out dates for the Western Caribbean Cruise are April 10 – November 6, 2010 and December 23, 2010. The 2011 block out dates for the Western Caribbean Cruise will be released in June 2010. Regardless of Grand Prize Vacation Package selected, the following apply: Actual dates of vacation are subject to availability and certain other restrictions. Travel may not occur during the cruise ship or airline blackout periods. Grand Prize Vacation Package is for the Winner and three (3) guests of the Winner’s choosing. The potential Winner will be required to sign and return a notarized Affidavit of Eligibility/Compliance including his/her Social Security Number as required for tax purposes (a potential Winner who is a resident of Canada must sign and return a Declaration of Compliance) and a Publicity/Liability Release, as allowed by law (collectively, the “Required Documents”). Failure to sign and return the Required Documents and other such requested documents by the return date specified in the Sweepstakes notification letter will result in forfeiture of the Grand Prize and, time allowing, selection of an alternate potential Winner. Winners who are residents of the United States will be issued a Form 1099 in the amount of the actual retail value of the Grand Prize. Minor guests under the age of 18 years not traveling with a parent or legal guardian must be accompanied by an adult over the age of 21 in the same stateroom. The parent or legal guardian of any minor guest not traveling with a parent or legal guardian must appoint an adult to have custody and control over their minor and to contract on their behalf in connection with the vacation. An appointment form will be included in the document package and must be signed by the parent or legal guardian and provided to Sponsor or Sponsor’s representative prior to embarkation at the Disney Cruise Line® terminal. Grand Prize Vacation Package may not be sold, traded, transferred or rescheduled to dates other than as set forth above. The Winner and guests are responsible for providing proper citizenship documentation to travel which may include passports, valid alien registration card and/or necessary visas. Those without proper citizenship documentation will be denied boarding. It is each guest’s responsibility to check with his/her travel agent, government agencies, embassies or consulates prior to their vacation to ensure that they have proper citizenship documentation. U.S. Citizens can also visit the State Department’s travel website at www.travel.state.gov, or call the U.S. National Passport Information Center at (877) 4USA-PPT for more information. Guests of all ages are strongly encouraged to obtain passports. Actual final retail value of Grand Prize Vacation Package may be higher or lower based on point of embarkation and dates of travel. The Winner and all guests must travel together on specified itinerary. All travel dates and arrangements are subject to change based on availability and providers’ approval. If the actual value of the Grand Prize Vacation Package is less than the stated estimated retail value, the difference will not be awarded. Neither the Grand Prize nor any component of it is redeemable for cash or transferable, except to a surviving spouse residing in the same household. No substitution allowed except, at Sponsor’s sole discretion, a prize of equal or greater value may be substituted. The Grand Prize cannot be used in conjunction with any other promotion or offer. Grand Prize elements may not be separated. The Grand Prize will be awarded provided it is validly claimed by the date specified in the prize award notification. After such date, no alternate potential Winner will be selected, nor any unclaimed Grand Prize awarded.
9. WINNER DISQUALIFICATION/SELECTION OF ALTERNATE POTENTIAL WINNER: At the sole discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate potential Winner may result from any of the following: (A) the potential Winner’s failure to respond to notification within the specified response period; (B) the return of an e-mail notification as undeliverable after three (3) attempts; (C) the return of any other notice as undeliverable; (D) the potential Winner’s failure to provide Administrator with satisfactory proof of age, identity and residency; (E) the potential Winner’s failure to execute and return the Required Documents within the specified return period; (F) the potential Winner’s failure to be available to take the Grand Prize Vacation Package; (G) the potential Winner’s failure to validly claim a prize by the date specified in the prize award notification; (H) the potential Winner’s guests’ failure to execute and return a Liability/Publicity Release by the specified return date; or (I) any other non-compliance with the Rules. In the event of a Grand Prize forfeiture, the Sponsor may, in its sole discretion, award or not award the forfeited prize to an alternate Winner. Winner and his/her guests are solely responsible for obtaining any and all necessary travel documents (valid photo I.D., etc.) before departure and must travel together on same itinerary. All taxes are solely the responsibility of the Winner, who if a U.S. resident, will receive an IRS Form 1099 reflecting the final actual value of the Grand Prize. In the event of a dispute as to the identity of the Winner based on an Address, the winning Entry will be declared made by the authorized account holder of the Address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an Address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted Address.
10. INTERNET/LIMITATIONS OF LIABILITY: Sponsor, Administrator, their respective parent, related, affiliated and subsidiary companies, their advertising, promotion and web design agencies, all other entities involved in the creation, administration, or fulfillment of the Sweepstakes and their respective successors, assigns, directors, officers, employees, agents and independent contractors (all of the former collectively referred to as “Sponsor & Others”) are not responsible for interrupted or unavailable network server or other connections; for miscommunications; failed telephone or computer transmissions; for jumbled, scrambled or misdirected Entries or transmissions; for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties; for other errors, omissions, interruptions, or deletions of any kind, whether due to electronic, human, mechanical, printing, production or technical errors or other causes; or for any damage to any person's computer related to participating in the Sweepstakes. Additionally, Sponsor & Others are not responsible for illegible, unintelligible, late, lost or stolen Entries; for incorrect or inaccurate Entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes; or for any technical or human errors which may occur in the processing of any Entries in the Sweepstakes. Persons found tampering with or abusing any aspect of the Sweepstakes, as solely determined by Administrator, will be disqualified and may be subject to prosecution. Any person attempting to enter using multiple Addresses, multiple identities or any other device or artifice to enter multiple times or to interfere with the proper play of the Sweepstakes will be disqualified from participation in the Sweepstakes. Additionally, any use of robotic, automatic, macro, programmed, third party or like methods to participate in the Sweepstakes will void any attempted participation effected by such methods and the disqualification of the individual utilizing the same. Administrator reserves the right to disqualify any individual found, in its sole opinion, to be tampering with the operation of the Sweepstakes; to be acting in violation of these Official Rules; or to be acting with the intent to disrupt the normal operation of the Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF the SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. If in the judgment of Administrator, the Sweepstakes is compromised by viruses, bugs, non-authorized human intervention or other causes which corrupt, or may corrupt, the administration, security, fairness or intended proper play of the Sweepstakes, Administrator has the right, in its sole discretion, to modify, discontinue, suspend or terminate the Sweepstakes and proceed to select potential winners in a manner it deems fair and reasonable including, without limitation, the selection of potential winners in a random drawing from among Entries received prior to any such modification, discontinuation, suspension or termination. SPONSOR & OTHERS MAKE NO WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT AS REGARDS THE GRAND PRIZE OR ANY COMPONENT OF THE GRAND PRIZE. AS SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS OF EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES. 11. PRIVACY POLICY: Any personally identifiable information collected during an entrant's participation in the Sweepstakes will be collected by Sponsor and used by Sponsor in accordance with Sponsor's Privacy Policy as such is stated at http://www.facebook-disneycruiseline.com/photos/DCLFanSpotlightDisneyPrivacyPolicy.htm.
12. PUBLICITY RIGHTS: By accepting the Grand Prize, the Winner agrees to allow Sponsor and/or Sponsor's designees the perpetual right to use his/her name, biographical information, photos and/or likeness, and statements for programming, promotion, trade, commercial, advertising and publicity purposes, at any time or times, in all media now known or hereafter discovered, worldwide, including but not limited to on the World Wide Web and Internet, without notice, review or approval and without additional compensation except where prohibited by law.
13. GOVERNING LAW: Except where prohibited, by participating in the Sweepstakes, participants agree that: (a) except as otherwise specifically set forth in these Rules, any action arising out of or relating to these Rules or the rights and obligations of any participant and/or Sponsor shall be filed exclusively in the U.S. District Court for the Middle District of Florida (or if the District Court shall not have jurisdiction over the subject matter thereof, then to the Circuit Court of the 9th Judicial Circuit in and for Orange County, Florida) and participants hereby consent and submit to the personal jurisdiction of such court for the purposes of litigating any such action, and any right to a trial by jury is hereby waived; (b) any and all disputes, claims, and causes of action arising out of or connected with these Rules, and/or the rights and obligations of any participant and/or Sponsor shall be resolved individually, without resort to any form of class action; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred and in no event will participants be entitled to receive attorneys' fees or other legal costs; (d) under no circumstances will participants be permitted to obtain injunctive or other equitable relief and a participant's sole remedy will be an action at law for damages to the extent allowed by sub-paragraphs (c) and (e) of this Rule 13; and (e) under no circumstances will participants be permitted, and participants hereby waive all rights, to: (i) claim punitive, exemplary, special, incidental, indirect and consequential damages and any other damages (whether due to negligence or otherwise), other than for actual out-of pocket costs described in (c) above; and (ii) have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of any participant and/or Sponsor shall be governed by and construed in accordance with the laws of the State of Florida without giving effect or regard to any principles or doctrines of conflicts of law of the State of Florida or any other jurisdiction. If any provision or provisions of these Rules shall be held to be invalid, illegal, unenforceable or in conflict with the law of any jurisdiction, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
14. RELEASE: By participating, each participant releases and agrees to indemnify and hold harmless Sponsor & Others from and against any and all costs, claims, damages, or any other injury, whether due to negligence or otherwise, to person(s) or property (including, without limitation, death or violation of any personal rights, such as violation of right of publicity/privacy, libel, or slander), due in whole or in part, directly or indirectly, to participation in the Sweepstakes, or arising out of participation in any Sweepstakes-related activity or travel-related activity, or the receipt, use or misuse, of any Grand Prize Vacation Package, travel or activity-related thereto whether hosted by Sponsor or a third party. The Winner acknowledges that he/she is solely responsible for any actions, claims or liabilities of his/her guests related to any Sweepstakes activity including, without limitation, any actions, claims or liabilities related to the guest's participation in a Grand Prize Vacation Package.
15. GENERAL: By entering this Sweepstakes, participants agree to abide by and accept these Rules and to comply with the Terms of Use and other contracts and policies governing the FACEBOOK platform (available at http://facebook.com/terms.php including Facebook’s privacy policy as stated at http://www.facebook.com/policy.php?ref=pf). Participants waive any right to claim ambiguity in these Rules or in the FACEBOOK Terms of Use. The decisions of Sponsor shall be final in all matters pertaining to this Sweepstakes. Void outside of the 50 United States/District of Columbia and Canada, in the Province of Quebec, Puerto Rico and where prohibited or restricted by law.
16. IMPORTANT FACEBOOK NOTICE: This Sweepstakes is not in any manner sponsored, endorsed, administered by, or associated with Facebook. Becoming a fan of Disney Cruise Line.com Fan Page on Facebook does not constitute an entry into the Sweepstakes. By participating in the Sweepstakes, each entrant releases and agrees to indemnify Facebook and hold it harmless from and against any and all costs, claims, damages, (including, without limitation, any special, incidental or consequential damages), or any other injury, whether due to negligence or otherwise, to person(s) or property (including, without limitation, death or violation of any personal rights, such as violation of right of publicity/privacy, libel, or slander), due in whole or in part, directly or indirectly, to participation in the Sweepstakes, or arising out of participation in any Sweepstakes-related or Grand Prize-related activity, or the receipt, enjoyment, participation in, use or misuse, of any Sweepstakes or Grand Prize - related activity, whether hosted by Sponsor or a third party.
